Eurocommissaris Viviane Reding ziet geen ruimte voor actie tegen Italië omdat daar de persvrijheid volgens critici van premier Berlusconi in gevaar is. In een ongemeen fel debat in het Europees parlement zei zij dat pluralisme in de geschreven pers een zaak is van de landen zelfs, en soms zelfs van lagere overheden.

Het verslag van dit debat door EUObserver biedt een goed overzicht van de speelruimte die Europa al dan niet voor zich ziet. Reding herinnerde eraan dat de lidstaten in de jaren negentig een poging van de commissie blokkeerden om een richtlijn op te stellen over mediaconcentratie.

Ook een beroep op mensenrechten is hier niet op zijn plaats, zei Reding volgens het verslag.

She went on to point out that the EU executive only has the power to enforce the protection of human rights when it comes to the actions of the EU institutions themselves and what member states do in the implementation of EU laws. What happens outside these two areas, even if there is a manifest breach of human rights, has to be left to the state concerned:  ”The fact that fundamental rights apply to EU policies does not make the EU competent for all matters related to fundamental rights in this or that EU member state.”

Guy Verhofdstadt, oud-premier van België en nu leider van de Liberale fractie in het Europees Parlement, was het daar niet mee eens.

It is on the basis of the treaty that we call on the commission to come up with a directive on media pluralism that would guarantee constitutional protections on media freedom in all countries of the union. I’m disappointed with the commissioner’s remarks. Member states can do whatever they want so long as in line with their own constitution? I don’t agree. There are things that need to be protected across Europe.
